Why might an insurer deny my claim?

When you suffer an injury in a car accident due to someone else’s negligence, then you can often make a claim against their insurance for payment for your injuries. While this may seem like a straightforward process, insurers are very good at nitpicking claims to avoid paying them. They want to limit the amount of money they pay out and maximize the amount they take in. For this reason, the insurance company may deny your claim.

According to Cover, insurers have many reasons they will deny auto accident claims that they apply to a majority of cases. Some of the reasons may be due to the terms and conditions of the policy but others are often an attempt to get out of paying a reasonable claim.

Policy issues

Often, when an insurance company denies a claim it is because the policy does not cover that type of damage or there is not enough coverage to cover the amount in the claim. Another reason may be if the person does not have valid insurance. Maybe he or she stopped paying the premium and the accident happened during a coverage lapse.

Legal issues

Sometimes an insurance company will claim a legal reason for not paying. This might be because the person was doing something illegal at the time of the accident or was violating a rule or stipulation in the policy. An example is if a person allowed someone else to drive his or her vehicle and that person was responsible for the accident. The insurance company of the owner of the vehicle may not pay for damages caused by a driver who is not on the insurance policy.
